GENERAL TERMS OF ACCESS TO AND USE OF THE PORTAL “https://cubitlab.com/en/” of Cubit s.c.a.r.l.

  1. INTRODUCTION

1.1. The Portal “https://cubitlab.com/” has been designed to provide easy and clear access to information on the goods and services offered, in line with the purposes and areas of expertise set out above, including the ability to download brochures and informational material, in accordance with these Terms of Use.

1.2. “Use” means any activity carried out by the User from the moment they access the Portal “https://cubitlab.com/”, including simple browsing, regardless of the access device (PC, smartphone or tablet), the type of connection (private, third-party, public or Wi-Fi) and the place from which the connection is made.

1.3. These Terms apply to everyone who wishes to browse the pages of the Portal “https://cubitlab.com/”.

1.4. The Portal pages are intended for adults only.

1.5. Where the Portal pages present and offer goods and services subject to specific terms and conditions set out on those pages, the latter shall prevail over these Terms.

2. FEATURES

2.1 The Portal accessed at the URL https://cubitlab.com/en/ complies with Italian Legislative Decree 196/2003 and with consumer protection legislation, and offers browsing Users the following features, by way of example and without limitation:

– learning about the expertise, aims, activities and trademarks of CUBIT S.c.a r.l., including their descriptive characteristics, fields of application and general use;

– learning about the aspects, channels and sectors of the commercial communication of CUBIT trademarks and/or products and services.

3. STAYING ON AND BROWSING THE PORTAL

3.1. By remaining on the Portal, the User accepts these Terms of Use without reservation. These Terms, as well as the features and fields of application, may be amended by CUBIT.

3.2. The User may not under any circumstances use the Portal for commercial purposes; use of the Portal is permitted for private purposes only, and the Service may be accessed solely by Users of legal age who connect to the Internet over IP (Internet Protocol) classes. Where the User requesting access is a natural person, they declare that they are at least 18 years of age. Any agreement entered into with a person under 18 shall be deemed invalid; the User therefore declares and warrants that the personal information provided is accurate, complete and truthful.

4. AVAILABILITY

4.1. Access to the Portal is provided “as is” and “as available”. CUBIT therefore accepts no liability as to its use or availability; access to the Portal may be temporarily interrupted for technical reasons related to maintenance. The User accepts that CUBIT may suspend, without notice, the operation of the service providing access to the Portal “https://cubitlab.com/” or sections thereof in order to carry out routine and extraordinary maintenance, and that CUBIT shall in no way be liable to the User for the unavailability of such service caused by a partial or total interruption.

4.2. The User acknowledges that CUBIT shall not be liable for delays, suspensions and/or interruptions in the provision of the services granting access to the Portal “https://cubitlab.com/” caused by:

  • force majeure or unforeseeable events;
  • tampering with or interventions on the connection software by third parties;
  • total or partial interruption of the access service caused by the telecommunications operator providing the interconnection service.

4.3. Access to the Portal or to sections of it may be subject to the creation of an Account, for which the User may be asked to provide identifying information, including through third-party applications.

5. OWNERSHIP AND CONFIDENTIALITY

Any material in the form of image files, video files, audio files or otherwise contained within, or accessible from, CUBIT’s Portal “https://cubitlab.com/” and covered by this agreement remains the exclusive property of, and/or exclusively licensed to, the Consortium and/or its sub-licensors. The User is prohibited from any use or dissemination, even non-commercial, of the trademarks, logos and, in general, any distinctive sign associated with the Portal in question.

6. AGREEMENT, GOVERNING LAW AND JURISDICTION

6.1. Should one or more clauses of these general terms of use be declared void following the application of a law, a regulation or a final judicial or administrative decision, the remaining clauses shall remain in full force and effect.

6.2. This agreement shall be governed by and construed in accordance with Italian law, to which reference is made for all purposes.

6.3. Any dispute regarding the interpretation and/or performance of the terms of access to and use of the Portal “https://cubitlab.com/” shall be submitted to the Italian courts and, in particular, to the exclusive jurisdiction of the Court of Pisa.
